Terms and Agreements

You must be at least 18 years old and authorized to act on behalf of any business you represent. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.

Lending Desk is not a lender. We help connect applicants with third-party funding partners. Any financing offer, including amount, rate, fees, and terms, is determined solely by the participating lender. Submission of an application does not guarantee an offer or funding.

When you submit an application, you authorize Lending Desk and its funding partners to verify the information you provide, including obtaining credit reports and bank data, to evaluate your application and any potential offer.

• Do not submit false, misleading, or fraudulent information.
• Do not interfere with or disrupt the Services or related infrastructure.
• Do not use the Services to violate any law or third-party rights.
• Do not attempt to access accounts, systems, or data that are not yours.

You consent to receive communications from us electronically and agree that electronic signatures, agreements, and disclosures satisfy any legal requirement that they be in writing.

The Services and all related content, trademarks, and software are owned by Lending Desk or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services as permitted by these Terms.

The Services may link to or rely on third-party services. We are not responsible for third-party content, products, or practices, and your use of those services is governed by their own terms.

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, Lending Desk and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Services.

You agree to indemnify and hold Lending Desk and its affiliates harmless from any claims, losses, and expenses arising from your use of the Services, your submitted information, or your violation of these Terms.

We may suspend or terminate your access to the Services at any time, with or without notice, including for suspected violation of these Terms. Sections that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in California, unless otherwise required by law.

We may update these Terms from time to time. Changes are effective when posted with a revised effective date. Continued use of the Services after changes are posted means you accept the updated Terms.
